This Competition is conducted by The Australian Chamber Of Fruit And Vegetable Industries Limited program ‘A better choice’ ABN 67 065 246 808 of 385 Sherwood Rd, Rocklea QLD 4106 (Promoter).

Competition entry constitutes acceptance of these Terms and Conditions.

All nomination instructions and information published by the managing body form part of these Terms and Conditions.

The competition entry is only open to residents of Victoria (VIC) aged 18 years or over. The promoter reserves the right to request any documentary evidence confirming the entrant’s age and to disqualify any entrant who is unable or unwilling to provide such proof of age upon request. Employees and their immediate families of the Promoter and their agents are not eligible to enter the Promotion.

The competition is open from 12:01am AEST on 11th April 2022, and ends at 11.59pm AEST on 17thJuly 2022 (Competition Period).

This competition is solely based on chance, and winners will be randomly selected.

To enter, an entrant must, during the competition period, visit this link which can be found online or instore, and:

(a) Input the requested information (as per ID), including the entrant’s full name, date of birth, email address, postcode, telephone number and your local ‘A better choice’ retailer;

(b) provide a short response to nominate your chosen retailer for our ‘Retailer of the Year Award’

(c) Competition entrants must reside in VIC only. 

(d) This competition is a game of chance. Skill plays no part in determining the winners. 

Any nomination which:

(a) is received outside the Competition Period or which fails to meet the requirements of clause 7;

(b) does not fully comply with these Terms and Conditions; and/or

(c) is incomplete, or otherwise unlawful,

is not a valid entry and will not be eligible to win.

Entries are only valid once per person, per week. 

(a) Entrants may only enter once.

(c) Holiday vouchers are only valid for the period they were issued. The vouchers will be distributed in a once-off capacity in the way of a voucher. The entrant may not submit under differing names or alias.

 

The selections will take place weekly. 

The successful entrants will be notified by the promoter by email and mobile telephone after the winning entries are selected, using the contact details supplied at the time of entry.

If the winner is unable to be contacted, or, upon being contacted and notified, rejects the voucher for whatever reason, or does not claim their voucher in accordance with the notification or other instructions issued by the promoter within 7 days of being notified by the store, their prize will be forfeited and an alternative delegate will be selected as per the unclaimed prize clause below.

Where the prize is unclaimed or forfeited, the promoter will select an alternate recipient at random. 

The winning entries will be allocated one of the below:

There are 5 different divisions for the win a holiday initiative that nationally will give away $25,000 of holiday vouchers. 

State-based  prize divisions:

QLD 10 x $500 = $5000 in total

NSW 10 x $500 = $5000 in total

VIC 10 x $500 = $5000 in total

SA 10 x $500 = $5000 in total

WA 10 x $500 = $5000 in total

There will be an additional $2500 grand prize given away on 3 August at the end of the campaign. 

 

The winners will be drawn for 10 weeks from the 18th of May- 20th July, or once each week on the following dates: 

18th May, 25th May, 1st June, 8th June, 15th June, 22nd June, 29th June, 6th July, 13th July, 20th July. 

Entries will be drawn from the existing pool with a cut off at 11:59 pm on every Tuesday prior to the above dates. Winners will be drawn at 12:00 pm on the dates above.

Winners in the period 18/5/22 to 15/6/22 will receive their prizes by 30/6/22.

Winners in the period 22/6/22 to 20/7/22 will receive their prizes by 31/7/22

The Grand Prize winner will receive their prize by 31/8/22

All winners will be contacted by the ‘A better choice!’ team directly. Winners must verify their details within 30 days of notification.

Prizes are not transferable or exchangeable and cannot be taken as cash, and will be in the form of a digital voucher.

The entrant consents to the promoter using and/or publishing their name and/or image, and/or quoting the winner’s submission or any other statements, including for promotional purposes, in any form of media (including on social media). The winner and their nominated store may be photographed and/or filmed during their receiving of the voucher, and it is a condition of acceptance of the voucher that the entrant consent to any use, publication or broadcast of such photographs or video.

Subject to any applicable law, regulation or permit condition, if for any reason beyond the control of the promoter this competition is not capable of running as planned, including for any reason which affects the administration, security, fairness or integrity of the Initiative, the promoter reserves the right in its sole discretion, (subject to any direction given by relevant regulatory authority), to cancel, terminate, modify or suspend the prizes.

The personal information you provide in connection with the nomination will be collected, stored and used in accordance with these Terms and Conditions and the Promoters Privacy Policy, located at this link. By entering the competition all nominators agree to the use and disclosure of their personal information to third parties as specified in these Terms and Conditions and the Promoters Privacy Policy. Where a nominator provides the personal information of any third party in connection with the nomination, the nominator warrants that the Promoter’s use of that personal information will not breach the Privacy Act or any other law.

Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any guarantee or implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void (Non-Excludable Guarantees). The Promoter party excludes from these Terms and Conditions all guarantees, conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non-Excludable Guarantee, the promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage whether direct, indirect, special or consequential, arising in any way out of the competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction; (b) any theft, unauthorised access or third party interference; (c) any nomination or voucher claim that is late, lost, altered, damaged or misdirected (whether or not after their entrance to the competition; (d) any variation in voucher value to that stated in these Terms and Conditions; (e) any tax implications; and/or (f) a voucher or use of voucher by a recipient.

These Terms and Conditions constitute the entire agreement between the Promoter and the Entrant. If any part of these Terms and Conditions are held to be invalid or unenforceable by a court of law, it will be severed and will not affect the remainder, which will continue in full force and effect.
